Article 35A: JKCSCC files writ petition in SC to challenge presidential order

Srinagar, Mar 11: Jammu and Kashmir Civil Society Coordination Committee (JKCSCC) on Monday claimed to have filed a writ petition before the Supreme Court (SC) of India to challenge the recent ordinance passed through the President of India.
Awami National Conference (ANC) Senior Vice President and JKCSCC member, Muzaffar Ahmad Shah talking to media persons during a presser said that the JKCSCC on behalf of people of Jammu and Kashmir has filed a writ petition before top court of India to challenge the recent presidential order, which he termed as an attack on Article 370.
He added such amendments have been done in the past for at least 41 times, but this time there is no elected government in the State and passing this order at this juncture is tantamount to an attack on the Article 35A and was not legally correct.
Assembly polls have also been delayed, therefore it seems the Article 370 and 35A will also be attacked like the way this Ordinance was passed, he added.
“We have filed a writ petition before SC to quash the order and the petition has been accepted and would most likely be heard on March 25,” he added.
Shah further said that this petition in SC is as important as petition on Article 370 and 35A, therefore, “we urge all the mainstream political parties, separatist camp, Bar Association and Civil Society to join hands at this time to fight against the move like we did on Article 370 and Article 35A.”
